Enrollment Terms & Conditions

1. Accepting These Terms

By signing the agreement, you acknowledge you have read and will abide by the Terms & Conditions and agree this purchase is a contract between you and us.

6. Paying For A Course Before Attending

After the 3 business days cooling off period, if you no longer wish to attend the course and want to cancel, a $100 USD cancellation and admin fee will be charged. The balance of monies you have paid will be held in credit. Credits cannot be refunded but can be used on any of our courses or products. This credit will not expire. If there is less than 1 month’s notice from the course start date, 25% of the total course amount will still be payable.

2. Cancellations

After the 3 business days cooling off period, if you no longer wish to participate in the course or program and want to cancel, a $50 USD cancellation admin fee will be charged. The balance of monies you have paid will be held in credit. Credits cannot be refunded but can be used on any of our courses, programs, trainings, or products. This credit will not expire.

7. Intellectual Property Rights

You agree that you will not distribute or transmit to another person any training program manuals or online training program access codes. You agree that if you break these commitments, you will be subject to possible prosecution and be removed from all future courses, bonuses, support, community groups and email correspondence without refund.

3. Refunds

If you email [email protected] within 3 business days from signing this agreement and advise us that you wish to cancel, we will refund 100% of the money you have paid to us within 10 business days.


Once you have paid a deposit for the program or paid for the program in full, you agree that you are not entitled to a refund and you agree that you are liable to honor the repayments for the program(s) you agreed to. After 3 business days cooling off period, no refund will be given (subject to Clause 9).

8. Happiness Guarantee

8.1 For 8-week Coaching Programs:  If you have fully participated and are not completely satisfied at the end of the 4th week, email [email protected] before the 5th week and we will refund the amount you paid. After the 4th week, there will be no refunds and the program will need to be paid in full.


8.2 For LIVE Training Programs: If you attend the entire course in full, have fully participated and are not completely satisfied, email [email protected] within 24 hours of completing the final course day and we will refund the amount you paid.

Each day of the course must be completed and you must have fully participated. This guarantee does not apply if you change your mind or are not able to attend the course. Refunds do not apply to LIVE training programs you may have received as a bonus, gift, transfer or course credit.


8.3 For Online Courses: You will be emailed your login details within 5 working days of the agreed payment being received. It is your responsibility to contact us if you have not received your login.

If you are not satisfied with the online course, you have 7 calendar days from the date your login details were sent to you (not the date you open the email), to email [email protected] and receive a full refund. Refunds do not apply to online courses you may have received as a bonus, gift, transfer or course credit.


After 7 calendar days, there will be no refunds and the course will still need to be paid for in full. This is regardless of whether you have logged in to use the program or not. Refunds do not apply for any training programs you received as a bonus.

4. Late Payments

5.1 Late payments may incur a fee of $50 USD.


5.2 Should you default on this payment for more than 60 days, under the Privacy Act 1988, information about the default can be shared with any credit reporting agency and debt collection agency to recover the outstanding balance.


5.3 If Payments are not made by the due dates, Courses or Training Programs may be cancelled and no refund given.

9. Access to the Course or Program & Bonuses

10.1 You have 12 months to begin the course or program from the date of signing this agreement (assuming the course or program is still being run).


10.2 When delivering a course, we may change course days, hours, speakers or locations for any reason by notifying you in writing (note: this has never occurred in the history of our company but is here in case of emergencies). We shall have no liability to you; and you shall make no claim against us (including refunds), in respect of the same.


10.3 We may cancel the course for any reason by written notice to you. We will then refund you the Investment you have paid us within 7 days of giving you notice of cancellation. We shall have no further liability to you in respect of cancellation. 

5. Transferring To Another Person

You can transfer your enrollment to another person. We require at least 1 month's notice prior to course or event start date, otherwise a late postponement charge of $100 USD is incurred.

10. Confidentiality

The Coaching Program relationship is 100% confidential. The Coach/Mentor recognizes that the Client may disclose future plans, business affairs and personal and financial information. The Coach/Mentor will not at any time, share this information with a third party. 


The Coach/Mentor realizes that the Client may have future plans, business dealings and proprietary information. The Coach/Mentor will not at any time, either directly or indirectly, use any such information for the Coach/Mentor own benefit.  


The Coach/Mentor will not divulge that the Coach/Mentor and Client are in a coaching and mentoring relationship without express consent of the Client. The Client, of course, is free to discuss the coaching and mentoring relationship with anyone at any time.


This confidentiality statement is intended to be as confidential as the applicable state or federal laws - and the Employer's own company policy (if applicable) - allows.  


The coaching and mentoring relationship is not privileged and, as such, the Coach/Mentor's records regarding work with a Client can be subpoenaed.



11. Limitation of Liability

You agree to limit any claim on Kelly Borowski or Healthy Wealthy Results LLC to the cost of the products or services purchased. This includes any loss or damage suffered by you in relation to the performance of the products or services purchased under this agreement.


The Client enters into the Coaching Program with the understanding that the Client is responsible for creating his or her own decisions and results.

If requested, the Coach/Mentor may give specific advice or suggestions; however it is ultimately the Client’s responsibility for making his or her own decisions determining the best course of action.


The Coaching Program relationship is in no way to be construed as psychological counselling or any type of psychotherapy. In the event that the Client feels the need for professional counselling or therapy, it is the responsibility of the Client to seek a licensed professional.  

The Client shall indemnify and hold the Coach/Mentor harmless from any loss or liability arising from actions taken or situations created as a result of the coaching and mentoring relationship.
